Today I was asked by a friend of mine regarding posting a link in an Indonesian website, where the link would direct the Indonesian’s website user to a foreign gambling website.Is it okay or not? considering the Indonesian website merely post a gambling related site which is hosted outside Indonesia.
What would be the latest regulation regarding gambling in Indonesia?
Indonesia has gambling enforcement act no. 07 1974 (criminal law), which focusing on offline gambling, such as gambling places, like the one in vegas (in a more smaller and shabbier scale of course..lol.).and in Jakarta sometimes we read in mags or watch on tv, the IND police raided an illegal gambling activities in chinatown area and such.
But this act was enacted in 1974 and no internet yet, where gambling activities were only limited to table,chairs, cards or slot machine,and money etc…
Nowadays, where internet is everywhere and connected people worldwide, that year 1974 gambling act does sound a bit out of date…the question would be how about online gambling activities?

Electronic Transaction and Information Act No. 11 2008, Chapter VII UNLAWFUL CONDUCT Clause 27 (2):
“Any person who, intentionally and without any rights, distribute and/or transmitted and/or make it accessible electronic information and/or electronic documents which has gambling content”
That clause could be interpreted to cover all gambling related contents in IND and abroad area, and it would be wise for website owner to ascertain that their website won’t bear any links related to gambling, either IND-owned online gambling site nor online foreign-owned gambling site.
